Your photos, videos and competitions

Welcome to the website of the London Scottie Club. You may wish to participate by sending to the Club your photographs or videos of your pets for publication on the Club’s website, or by entering one of our competitions that we may run from time to time. There are some rules to guide you, and, as for photographs, videos and the like. An important rule is you must not do anything in breach of someone else’s property rights or copyright.

Your photos and videos

If you would like to send to the London Scottie Club by email or by post photographs or videos, because you would like to see them on the website, there are some conditions of use. In the case of videos, content is managed via YouTube. Please ensure that you have your own copies, because the London Scottie Club will not return them to you – the Club is run by volunteers with limited time and resources. The London Scottie Club may at its complete discretion publish (or decline to do so) on its website or YouTube Channel some or all of the photographs and videos sent to the Club. The Club reserves the right at any time to remove from its website or YouTube channel any material for any reason whatsoever.

The London Scottie Club will not accept any photographs or videos containing advertising material, or which have a commercial purpose.

You must not send to the London Scottie Club material, which breaches any copyright law or laws, or for which you do not have the intellectual property rights. If you fail to comply with this important rule, the Club will remove any such material from the website, and you will be responsible in law to any parties alleging that you have breached their copyright or other rights. You must have the permission of any humans participating directly in the photograph or video for your use of the material.

If your video includes a soundtrack, such as music, you must ensure that you comply with copyright law. If, for example, it is subject to a Creative Commons Licence, you must include a proper attribution appropriate to the Licence. You own, and are responsible for, any information that you send to the London Scottie Club that you wish it to publish on the Club’s website.

These Rules also apply to material that you post to the London Scottie Club’s Social media sites such as Facebook, Twitter and /or Instagram, or its WhatsApp groups, “London Scottie Club Convo” or “London Scottie Smart Mart”. The Club will remove any feeds in breach of these Rules.

You also consent to any downloads of your material posted on the London Scottie Club’s website, YouTube Channel or social media sites.

WhatsApp

London Scottie Club hosts WhatsApp messenger groups called “London Scottie Club Convo” (“Convo”) and “London Scottie Club Alerts” (“Alerts”) and “LSC Smart Mart” (“Smart Mart”). Convo and Smart Mart allow members to post their photographs and videos as well as text on the WhatsApp groups where it is automatically shared with other members. Members are expected to comply with privacy and copyright conditions as detailed elsewhere in this Terms & Conditions and Privacy Policy.

London Scottie Club reserves the right to reproduce any or all of the photo images or videos shared on the Convo by LSC members on its website and/or LSC YouTube Channel. Any content shared on the WhatsApp messenger groups can be reproduced on the LSC website without seeking prior permission. But we request that content shared on WhatsApp is the copyright of the member uploading. For YouTube, the privacy rules are the same, and follow.

We also discourage posts on WhatsApp Convo which are designed to solicit sales of Scottish Terrier or other canine puppies, or of commercial products. If Members have a litter, they are allowed to announce it once on WhatsApp Convo and to ask that interested buyers contact the Member directly for more information. London Scottie Club will not allow the publication of progress reports on puppies in the litter or photos of the said puppies and may remove posts that breach this condition. We will only allow the Member or new owners of the puppies to post photos once the litter has been completely distributed to new homes. The breeder must inform London Scottie Club of this event.

As a not-for-profit entity, London Scottie Club cannot allow images to be distributed via WhatsApp with the intention of soliciting commercial business. We allow only for announcements for information purposes only, and London Scottie Club is at no point part of the sales process, does not endorse the sales process, and will not intervene in the sales process to arbitrate for Members.

London Scottie Club is for Scottish Terrier owners who keep their dogs as pets. Professional breeders do not qualify for membership of the London Scottie Club. If any member of the club turns professional breeder they will be required to leave the London Scottie Club.

YouTube

London Scottie Club manages a YouTube Channel. London Scottie Club reserves the right to reproduce any or all of the photo images or videos shared on the “London Scottie Club Convo” WhatsApp messenger group on its website and/or LSC YouTube Channel. But we request that content shared on WhatsApp is the copyright of the member uploading.

All videos from 2020 onward on the LSC website are powered by YouTube, and that same content may be publicly available on YouTube.

Content shared on WhatsApp implicitly confers the material is no longer private to the owner or others depicted therein, as the person sharing the content is assumed to have confirmed copyright and checked with anyone else depicted that they do not object to publication.

Heatmap

We also add Members with Scotties to the London Scottie Club Heatmap. The Member’s approximate location is shown on a map powered by Google. Screenshots are shared for editorial purposes on website LondonScottie.Club. We do not reveal contact details nor share locations with anyone other than the London Scottie Club Committee which administers the London Scottie Club. All data is held in accordance with the GDPR rules which came into force in May 2018.

Competitions

From time to time the London Scottie Club may run quizzes or competitions. If you enter such competitions, you will be bound by the rules. They will include the provision that members of the Club’s governing committee and their family members will not be allowed to participate in any such competition.

Changes to the Rules

The Internet and electronic technology is always changing, so the London Scottie Club most likely will change these Rules from time to time. You must therefore check the Rules for such changes, and it is your responsibility to keep up to date with them.

These Rules shall be governed and subject to the laws of England, and any dispute shall be subject to the jurisdiction of the courts in England (which includes Wales).
